Terms and Conditions of Purchase
1. General Conditions
1.1. These rules of the DEKOTI online store (hereinafter referred to as the "Rules") are established to ensure the rights of the Buyer (hereinafter referred to as the "Buyer") and MB Panja Baltic, the seller of goods in the online store www.dekoti.lt (hereinafter referred to as the "Store"), company code 306958087 (hereinafter referred to as the "Seller"), to define the obligations, responsibilities, and other provisions related to the purchase and sale of goods in the Store.
1.2. The remote purchase and sale contract is considered concluded when the Buyer forms a goods order from the Seller’s offers in the DEKOTI online Store, selects the payment method, provides the delivery address, and confirms the order. The contract is valid until it is fulfilled or terminated in accordance with the Rules or legal regulations. Violation of the Rules may be grounds for terminating the remote contract.
1.3. Before using the online Store and the offers provided by the Seller, the Buyer must carefully read and familiarize themselves with these Rules. By purchasing goods in the online Store, the Buyer confirms that they agree to the application of these Rules.
1.4. The Seller reserves the right to unilaterally change the Rules at any time by publishing the updated Rules on the online Store’s website. The changes come into effect from the moment of publication and apply to all transactions concluded after publication.
2. Buyer's Rights
2.1. The right to purchase in the Seller's online Store is granted to Buyers: capable natural persons, legal entities, and authorized representatives of all the aforementioned persons. By agreeing to these Rules, the Buyer confirms that they have the right to purchase in the Seller's online Store.
2.2. The Buyer has the right to withdraw from the remote contract within fourteen days without giving any reason and without incurring any costs other than the direct costs of returning the goods, except for the exceptions provided in point 2.3 of the Rules.
2.3. The list of contracts that cannot be withdrawn from is provided in Article 6.228(10) part 2 of the Civil Code.
2.4. The Buyer can exercise the right to withdraw from the purchase and sale contract under the conditions set out in point 2.2 of these Rules only if the returned item meets the following requirements:
2.4.1. The item must not be used, must be undamaged, and must not have lost its value;
2.4.2. The item must be returned in its original manufacturer’s packaging (the packaging may only be altered as much as necessary to inspect the item) and must not have lost its commercial appearance;
2.4.3. The item must have all labels attached.
2.5. The Buyer shall notify the Seller of the withdrawal from the remote contract by submitting a properly completed standard withdrawal form, which can be found here: https://e-seimas.lrs.lt/portal/legalAct/lt/TAD/2c2983a0d0d011e39b2ab5bbcc4f49fb/asr or by submitting a clear statement of the decision to withdraw via the contact details provided in the “CONTACTS” section of the DEKOTI website.
2.6. Goods are returned after coordinating the time and place for the collection of goods in advance.
2.7. The money paid for accepted but later withdrawn and returned goods will be refunded to the Buyer’s account from which the payment was made within 14 (fourteen) days from the day of receipt of the Buyer’s notice of withdrawal.
2.8. When returning quality goods, the Buyer is refunded only the amount paid for the goods, excluding the shipping and return fees of DEKOTI.
3. Buyer's Obligations
3.1. The Buyer must accept the goods according to the procedure established by these Rules and pay the agreed amount for them.
3.2. By using the online Store, the Buyer undertakes to comply with these Rules and not to violate the laws of the Republic of Lithuania.
3.3. If the Buyer refuses to accept the goods at the time of delivery, which are subject to the right of withdrawal, it is considered that the Buyer has withdrawn from the purchase and sale contract, and the Buyer must return the goods to the Seller according to the procedure established by the Rules.
4. Seller's Rights
4.1. In the event of significant circumstances, the Seller may temporarily or permanently suspend the online Store’s activities without prior notice to the Buyer.
4.2. The Seller has the right to cancel the Buyer's order without prior notice if the Buyer, having chosen the payment method "Bank Transfer," does not pay for the order within 2 (two) business days.
5. Seller's Obligations
5.1. The Seller undertakes to allow the Buyer to use the services provided by the online Store www.dekoti.lt under the conditions specified in these Rules and the online Store.
5.2. The Seller undertakes to deliver the goods ordered by the Buyer to the postage machine specified by the Buyer under the conditions specified in these Rules.
5.3. If the Seller is unable to deliver the ordered goods to the Buyer due to significant circumstances, the Seller undertakes to offer an equivalent or similar product. If the Buyer refuses to accept an equivalent or similar product, the Seller undertakes to refund the amount paid by the Buyer within 5 (five) business days.
6. Product Search, Selection, Ordering
6.1. The Buyer browses the online Store, searches for goods by categories, or uses the search function to find the desired product.
6.2. The online Store provides product information: product description, photos, price, and other related information.
6.3. After selecting the product, the Buyer adds it to the virtual shopping cart. The Buyer reviews the products in the cart, their quantity, the estimated delivery time, and the total amount.
6.4. The Buyer provides the delivery address, selects the payment method, and confirms the order. The online Store system processes the order and sends the Buyer a confirmation email.
6.5. The contract becomes valid when the Buyer clicks the "Confirm Order" button, and upon receiving the order, the Seller confirms it by sending a confirmation email to the email address provided by the Buyer.
6.6. If the Buyer chooses to pay for the goods by bank transfer, the Seller has the right to cancel the order without prior notice if the Buyer does not pay for the goods within 2 (two) days from the order submission.
6.7. A delivery fee applies to the delivery of goods to the specified postage machine. DEKOTI reserves the right not to apply the delivery fee if the order amount reaches or exceeds a certain amount unilaterally determined by DEKOTI. The delivery fee is not included in the minimum order amount.
7. Delivery of Goods
7.1. The goods ordered by the Buyer are delivered to the locker specified during the order. The goods can be delivered to Omniva, LP Express, and DPD postage machines.
7.2. The order is prepared within 1-2 days. Once the order is ready, the Seller sends an email to the Buyer informing them that the goods have been shipped and provides the tracking number.
7.3. The goods are delivered to postage machines in Lithuania within 1-3 days from the time the tracking number is provided to the Buyer.
7.4. The Buyer is not responsible for any delay in delivery once the goods are handed over to Omniva, LP Express, or DPD postage machines.
7.5. Upon accepting the goods, the Buyer must check the condition of the package, the quantity, quality, and assortment of the goods. If package damage is found but no discrepancies in quantity, quality, or assortment are detected, the Buyer must take a photo and inform the shipping service about the package damage. In this case, it is considered that the goods were delivered in a damaged package, but the quantity, quality, and assortment of the goods comply with the terms of the purchase and sale agreement, and the delivery is considered properly completed.
7.6. Goods can be delivered in another mannes only upon separate agreement with the Seller.
8. Payment Methods, Terms, and Conditions
8.1. Prices for goods are indicated in euros. Goods are sold at the prices valid at the time of order submission. Bank fees may apply depending on the bank used by the Buyer.
8.2. The Seller is not a VAT payer.
8.3. The minimum order amount is €9.99.
8.4. The Buyer can pay for the goods using one of the following methods:
8.4.1. We use the Stripe platform to accept payments. For more information on its security: https://stripe.com/docs/security/stripe
8.4.2. Payment by bank transfer is a prepayment where the Buyer transfers the money to the e-store’s MB Panja Baltic bank account. The Seller begins processing the order once the payment for the goods and delivery is received in the Seller's bank account.
8.5. By entering into the Agreement, the Buyer agress that an electric invoice with purchase details will be sent to the email address provided at the tima of purchase. The invoice will be sent via email no later than 3 days from the moment the Seller dispatches the Goods.
9. Product Quality
9.1. The properties of the sold goods are indicated in the product description accompanying each product.
9.2. The products displayed in the online Store may differ in color, shape, or other parameters from the actual size, shape, and color of the goods due to the features of the Buyer’s electronic devices or other technical reasons, as well as considering reasonably possible appearance discrepancies.
10. Discounts, Promotions, Gift Vouchers
10.1. The Seller reserves the right to apply various promotions or discounts at the online Store.
10.2. The Seller can provide gift vouchers to Buyers, which can be used to purchase goods at the Store.
10.3. The conditions for applying discounts or promotions are determined by the Seller independently.
11. Privacy Policy
11.1. By purchasing in the online Store, the Buyer agrees that their personal data will be processed according to the procedure established in these Rules and the Privacy Policy.
11.2. The Seller undertakes to process the Buyer's personal data exclusively for the purposes and in accordance with the procedure established in these Rules and the Privacy Policy.
11.3. The Buyer's personal data is collected and processed for the purposes of the sale and delivery of goods, as well as for marketing purposes. The Seller undertakes not to disclose the Buyer's personal data to third parties, except for the Seller's partners who provide delivery or other services related to the Buyer's order. In all other cases, the Buyer's personal data may only be disclosed to third parties according to the procedure established by the laws of the Republic of Lithuania.
12. Final Provisions
12.1. Any disputes arising from the application of these Rules shall be settled by negotiation. If no agreement is reached, disputes are settled in the courts of the Republic of Lithuania according to the procedure established by the laws of the Republic of Lithuania.
12.2. These Rules are governed by the laws of the Republic of Lithuania.
